In this Privacy Policy, “we”, “us” and “our” means Genuine Health Corporation and its affiliates, including Genuine Health Inc. (“Genuine Health”).

1. Our Privacy Commitment to You

Genuine Health recognizes the importance of an individual’s right to keep personal information private. We have made a commitment to use our reasonable efforts to ensure that personal information gathered through this website (“Website”) remains secure and is not used in a manner that is inconsistent with this Privacy Policy, American privacy law and our Terms and Conditions of Use, which can be accessed by clicking here. We do this by adhering to the principles stated below that relate to the collection, use, retention and disclosure of your personal information.

1.2 This Privacy Policy does not apply to information that we may collect from you by other means (including offline) or from other sources. It governs the collection, use and disclosure of the information we obtain from you when you subscribe for our online newsletter service or complete online purchases of our products or services, and any other information obtained from you through e-mail communications, whether general inquiries or otherwise, related to Genuine Health’s services and products. We use all information collected from you to the extent necessary to operate our programs, to provide the required services to you, to process, confirm, and arrange for receipt of payment for your online purchases of our products and services, and to help in the development of Genuine Health products and services. 2. What is Personal Information?

As used in this Privacy Policy, “personal information” means information about an identifiable individual; it is information by which the identity of an individual can be deduced. However, personal information does not include the name, position or title, business address or business telephone number of an employee of an organization. It also excludes publicly-available information, such as information listed in a public telephone directory.

This includes information under the direct control of Genuine Health, as well as personal information that Genuine Health may transfer to its affiliates, agents or to third party service providers for processing, storage or other purposes that facilitate Genuine Health’s business operations or, where required, that have been consented to by the individuals to whom the information relates. We will use contractual or other measures to require third parties that process information on our behalf to maintain a level of privacy protection comparable to our own practices. However, from time to time third parties may offer products or submit informational material through our Website. If you follow links to these third party websites, we have no responsibility for their use of any information you submit to them or that you expressly authorize Genuine Health to provide to them. You should read and understand the privacy policy of all third parties before giving them any personal information as their privacy policy may be significantly different from that of Genuine Health.

3.2 To ensure accountability for personal information collected, used and disclosed by Genuine Health, we have developed the policies and practices summarized here, and have trained those individuals within our organization that deal with personal information.

4. Our Collection, Use and Disclosure of Personal Information

The information we collect through this Website is helpful to us in the development of Genuine Health services and products, but respect for our customers, subscribers and other individuals and their privacy rights motivates us to closely guard and protect that information. Except as we otherwise advise you, as may be required to complete any transaction authorized by you, or as may otherwise be permitted and required by law, and, without limitation, to fulfill regulatory and law enforcement requirements, we do not share the individual information we gather on our Website with third parties.

4.2 Whenever Genuine Health collects personal information on this Website, we will disclose the purposes for which we are collecting the information, the manner in which we plan to use the information and the entities to whom the information will be disclosed, if such information is to be used other than as expressly stated in this policy. We may use and disclose the personal information we collect from our customers, newsletter subscribers and other individuals who establish an account or provide us with their personal information to manage our relationship with such individuals, to administer accounts, to provide requested business services, to process online purchases and to otherwise carry on our business operations. When you create an account for this Website, we require certain information such as your name, age range and address. We also require you to pick a user name and a password. We ask you to provide certain information about yourself to assist us in understanding our customers and their preferences. For example, we may ask you to provide us with the following information: gender, income range, education and marital status. If you want to subscribe for our newsletter, we also require your e-mail address. By providing us with your e-mail address you are expressly consenting to receiving any necessary communications from Genuine Health electronically, including information about your pending or completed transactions with us, in lieu of receiving such communications in paper form. 4.3 If we choose to use personal information already in our custody for a purpose that was not identified at the time we initially collected the information, unless the new purpose is required or authorized by law, we will seek the consent of the affected individuals before using this information for these new purposes.

4.4 In addition to identifying the purposes for which personal information will be used and to whom it may be disclosed, we will obtain the consent of the individual to whom the information relates before we collect, use or disclose this personal information. Individuals may withdraw consent at any time by contacting our Privacy Officer at the contact information listed below.

4.5 We will not refuse to provide a service to an individual if they choose not to provide us with their personal information, unless their failure to provide the information makes us unable to provide the service. However, for any services or products purchased through the Website, we must be provided with personal information, including credit card billing information as required by the credit card providers such as VISA or MasterCard.

4.6 If you are or will become a customer of Genuine Health, you were asked or will be asked to complete credit and payment information on a pre-determined form used by Genuine Health (and modified from time to time) so that we may open an account for you and establish a business relationship. The personal information you are required to provide includes:

  • your name;
  • your e-mail and postal addresses;
  • your telephone number; and
  • your credit card information (type, number and expiry date).

4.7 The credit card and payment information you provide plus a record of your purchasing history is maintained on file for as long as you continue to keep an active account with Genuine Health and for a reasonable time thereafter. Whenever you make a purchase using a credit card, we authenticate the card prior to filling the order. We may also use the services of trusted third parties to validate your card and to process any purchases that you make through the Website. We will contractually require that any personal information that is disclosed by us to these parties will only be used by them for these purposes and will not be used or disclosed by such parties for any other purposes.

4.8 When a customer contacts Genuine Health with a question or concern regarding one of our products, we record the following information:

  • name, address and telephone number of the customer;
  • product description including lot #;
  • date and nature of the inquiry;
  • outcome or resolution of the inquiry.

4.9 The information we collect is summarized and used to determine the need for further investigation so that we can more effectively manage our business relationship with our customers.

4.10 Genuine Health solicits input from recipients of our online newsletter. When a reader sends comments to Genuine Health, these comments may be incorporated into future newsletters or displayed on this Website. A respondent’s full name will never be used and the comments may be edited for clarity and length.

4.11 In addition, Genuine Health may collect certain personal information from customers through contest entry forms and e-mails. Contest participants are asked to provide their name, address, telephone number, e-mail address and whether they would like to receive our on-line newsletter. The ballots are securely destroyed once the contest has been completed.

4.12 Our use of your personal information will be limited to the purposes for which it was collected, and disposed of in a reasonable and responsible manner when it is no longer needed.

4.13 We are committed to protecting children’s privacy. Please be aware that this Website, and the products, services and information available therein, are not designed for or directed to children under the age of 13. We do not collect personally identifiable information from any person we actually know to be under 13 years of age.

5. OTHER INFORMATION GENUINE HEALTH COLLECTS
5.1 As with most Internet sites, this Website collects a variety of technical data, including your IP address (a unique number that identifies your access account on the Internet), domain, and World Wide Web browser information. We do not log the specific identity of visitors. Technical data is used only to create broad demographic summaries of site usage and activity (such as average time spent and pages viewed) to assist us in providing useful content that is tailored to be of most value to our users. For example, we use the information to give the developers of this Website information that is useful in determining appropriate new features, content, and services, and to provide advertisers, partners and clients with aggregate – not individual – information about our user base.

5.2 This Website may use “cookies” or other tracking technology. This tracking technology allows users to move more quickly through this Website. For example, cookies are small text files that a website can use to recognize repeat users and facilitate the user’s ongoing access to and use of this Website. A cookie may store your password, or note your particular areas of interest. Generally, cookies work by assigning a unique number to the user that has no meaning outside the assigning site. We do not record or store any information about your movements on the Internet outside of the www.genuinehealth.com site. You can choose to decline our cookies (e.g., by setting your browser to reject cookies), but if you do, some parts of this Website may not operate properly.

6. Access and Correction of Personal Information
6.1 We are committed to open and fair privacy practices. We keep personal information as accurate, complete, current and relevant as necessary for identified purposes.

6.2 Any individual may inquire about the personal information that Genuine Health has in its custody by contacting our Privacy Officer at the contact information listed below. After receiving a request, our Privacy Officer will inform the individual of the existence, use and disclosure of their personal information and will allow the individual to access the information. Your rights to access your personal information are not absolute. In certain circumstances, access may be denied. If we deny an access request, we will advise you in writing of the reason for the refusal. You may then challenge our decision.

6.3 Where personal information that is used on an on-going basis is not accurate, complete, and up-to-date, upon being advised of the inaccuracy, the Privacy Officer will take steps to reasonably ensure that this information is amended. As Genuine Health does not routinely update personal information we collect, please ensure that you keep your information current through the account management page available here.

7. Unsolicited E-mail (SPAM)

In accordance with this Privacy Policy, except as we otherwise advise you, we do not sell or lease our customer list to third parties. You should be aware, however, that unscrupulous marketers can sometimes “harvest” your e-mail address directly from your computer or another person’s address book or even obtain your e-mail address through programs that automatically search web pages and e-mail traffic for e-mail addresses.

7.2 Please note that all e-mail from us will display the GenuineHealth.com logo (HTML e-mails) or contain the Genuine Health Inc. copyright notice (text e-mails). In addition, our e-mails will contain our corporate address in Toronto, Ontario.

8. Inquiries, Requests or Complaints

Numerous individuals within our organization are responsible for the day-to-day collection and processing of personal information. However, Genuine Health has a designated Privacy Officer who is ultimately accountable for the handling of all personal information under our control and for ensuring that the principles set out in this Privacy Policy are being complied with. 9. Changes to this Privacy Policy
9.1
This Privacy Policy is effective as of the date set out at the top of the policy.

9.2 Genuine Health reserves the right to change this Privacy Policy from time to time. If Genuine Health makes a material change, this Privacy Policy will be updated accordingly.
